Consent must match the operation
Permission to sublet, share or conduct a business may not necessarily authorise recurring paid guest accommodation. Provide the owner with a factual use schedule covering guest categories, stay profile, channels, maximum occupancy, access, services, cleaning, inspections, insurance, approvals and complaint handling. Avoid relying on labels such as corporate lease or serviced accommodation. Attach the operating description to the agreement so both parties can identify what is permitted.
Authority and conditions
Confirm all required owners and authorised representatives. Company, trust, co-owner, mortgagee or agency arrangements may affect who can agree. Ask a solicitor to advise where authority or document structure is unclear. Use conditions precedent for matters that must be satisfactory before launch, such as strata, council, registration, building, safety and insurance. State what happens if a condition fails or is delayed.
Change control
Consent should not be treated as unlimited. A material change in guest type, occupancy, services, stay length, access or channels may need further review. Create a process for notifying and approving changes. Keep the owner informed through agreed reporting and incident escalation. Informed consent is supported by accurate operation over time, not only the signature date.
